§ 1 GENERAL PROVISIONS

1. The Controller of your personal data obtained via the website www.paukpakostane.com is GRUPA UCHACZ SPÓŁKA AKCYJNA SPÓŁKA JAWNA, with its registered office at Podłopień 303, 34-650 Tymbark, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the city of Cracow-Śródmieście under the number KRS (entry no.)  0000077834, NIP (taxpayer ID): 7371862099 hereinafter referred to as "Controller" (and also Service Provider)

2. This Privacy Policy defines the rules for controlling the personal data within the electronic services provided by a Service Provider.

3. The Service Provider allows its Users to use free electronic services described in this paragraph via the website, provided 24 hours a day, 7 days a week. These services enable Users to use the Internet resources,  including familiarising themselves with the materials presented on the website and using various IT mechanisms functioning within its framework.

4. Available electronic services via the website are as follows:
1. The contact form as a service enables the User to send messages to a Service Provider. A service agreement providing an interactive form is conducted for a definite period and is dissolved when the Controller receives a message.

2. Recruitment form – the recruitment form entails entering the required User's data, including personal data for current purposes, alternatively for future recruitment processes conducted by the Controller as an employer. The service agreement that allows the Users to use the form for recruitment purposes is undertaken for a definite period, and it ends respectively when the Controller receives the data for recruitment purposes.

5. The operator reserves the right to choose and change the type, form, time and manner of providing access to the selected services mentioned above. He will inform the Users about any updates in the privacy policy.

6. The Users' personal data are processed in accordance with general regulation of the European Parliament and Council (UE) 2016/679 of 27 April, 2016 on the protection of individuals by processing the personal data and on the free movement of such data (hereinafter "RODO") and national regulations on the protection of personal data and the act on the provision of electronic services of 18 July, 2002 (Dz.U.2017.1219, i.e. as amended)   

7. The Controller seeks to protect the interests of individuals to whom the data relates. In particular, the Controller ensures that the data they collect is processed in accordance with the law; collected for the marked Users for specific, lawful purposes and not subject to further processing incompatible with these purposes; factually correct and adequate concerning the objectives for which they are processed and stored in a form that allows identification of persons they relate, no longer than it is necessary to achieve the purpose of processing.

8. The Data Controller has not appointed a personal data Inspector.

9. It is possible to visit the website conducted by the Controller without providing personal data. Providing personal data is voluntary, but it could be necessary to conclude the agreement or other to which the person providing the data agrees, e.g. to use the contact form.


§2 PURPOSE, SCOPE AND BASIS FOR DATA COLLECTION

1. The purpose of personal data processing by the Controller is as follows:

1) To establish, shape the content, change or by dissolving the contract between the Service Provider and the Service Recipient in the provision of electronic services.

2) For direct marketing of own products or the Controller's services;

3) Taking into account the Users who use the recruitment form provided by the Controller, personal data entered are being processed for the needs of current or future processes provided by the Controller.

2. The Controller processes the User's personal data such as IP, first name and surname, date of birth, e-mail address, telephone number, and residence address (street, house number, apartment number, postcode, place of living, country, marital status, professional qualifications). The Controller may process other data categories if they are entered on your own and freely by the User into the forms available on the website.

3. In accordance with Act 2 of this paragraph, providing personal data is voluntary. However, it may be necessary for the website management by the Service Provider and to conduct recruitment processes in particular. Suppose the User failures to submit the required data before the commencement of the provision of a specific service. In that case, it will result in the refusal to perform the service due to the inability to provide it. The User is informed about the required data scope each time before delivering a specific service.

4. A basis for processing the User's personal data is consent or the need to perform the contract to which the User is a party or take action of its request or after its conclusion as well as direct marketing of own products or Controller's services.

5. Personal data provided by the Users will not be shared with other entities except those with an appropriate legal basis, including data processing agreement in a no less restrictive manner than that provided by the Data Controller.


§3 OPERATIONAL DATA

1. The Controller may process the following data characterizing the way the User uses the website with the help of appropriate software (operational data):

1) Markings identifying telecommunications network terminations or ICT systems used by the Service Recipient;

2) Information about the start, end and scope of each use by the Service Recipient of the service provided by electronic means;

3) Information about using of services provided by electronic means by the Service Recipient;

2. Operational data is of aggregated and anonymous character, i.e. it does not contain features that identify visitors to the website and are not disclosed to third parties.  


§4  THE RIGHT OF CONTROL, ACCESS TO YOUR OWN DATA AND ITS CORRECTION

1. The User has the right to access their data and to rectify the data or the right to delete the data, the right to limit data processing, the right to request the data to be transferred, the right to object to data processing, the right to withdraw their consent to the processing at any time without affecting the lawfulness of processing based on consent before its withdrawal;

2. Each person has the right to control the processing of data contained in the Controller's data set at this point, and in particular, the right: to request supplementation, update, the rectification of personal data, temporarily or permanent suspension of their processing or their removal, especially if they are incomplete, outdated or have been collected in violation of the Act or are no longer necessary to achieve the purpose for which they were collected.

3. Taking into account data processing for the direct marketing of the Controller's products or services, the data subject is entitled to submit a written request to stop processing its data and to object to the processing of this data.

4. To exercise the rights mentioned above, one may send an appropriate request via e-mail to the address: info@paukpakostane.com or in writing to the Controller's registered office address.

5. Each person has a right to submit a complaint to the  President of the Office for Personal Data Protection (formerly GIODO) when they consider that data processing violates the provisions of the general regulation on the protection of personal data of 27 April, 2016.


6. Personal data will not be transferred to a third country/international organization.

7. The personal data will be stored for a period necessary to conduct the agreement of the provision of a service by electronic means and exercise the purpose for which it was completed, and in the case of data for recruitment purposes resulting from the needs of the employees, unless a person it concerns will use previously entitled rights as referred to in Act 1 and 2 of this paragraph.

8. The Controller will not process the data in an automated manner or the profiling form. However, it should be taken into account that partners cooperating with the Controller that are indicated in § 5 of this policy process the data collected via the website: www.paukpakostane.com to conduct analyses, the research of user preferences and adapt the website to the expectations of Users, including also preventing the advertisement based on the User's interests. These data are in particular: IP address (Internet Protocol), geolocation data derived from the User's IP address, mobile advertising identifier (MAID) (which enables application programmers to specify who uses their mobile applications), mobile advertising ID, a browser type, a browser language, operating system type and date and time at which the end User visited the Publisher's website, behaviour on the Publisher's website such as time of browsing the Publisher's site by the User, behaviour on the end User in the content on the Publisher's website, content they provide and their interests, the relevant URL and methods of searching on the website that the User uses to locate and visit Publisher's websites, information on the use of tools by Users (to search for specific content on the website or sharing the content) offered by the Publisher's partners and shared on the Publisher's website. Based on these data, marketing profiles of advertising recipients and analysis of website functionality to customize the website to Users' preferences are created.

9. The data specified in Act 8 is collected via cookies. Information about how to comply with and manage cookies, including blocking their usage, is available in § 5 of this paragraph.


§5 COOKIES POLICY

1. Cookies are text files stored on the User's computer when they access a website. They allow the website to recognise the User's computer. These files, in most cases, do not allow identification of the network User's identity. Cookies do not cause any damage to the User's computer and cannot infect computers with viruses.

2. Two types of cookies on the website are commonly used – session cookies and permanent ones. Session cookies are temporary files stored on the User's device until the website is left or the web browser has been turned off. Permanent cookies are stored on the User's device when specified in the cookies' parameters or until the User deletes them.

3. The Controller may use its cookies, in particular: to modify the configuration of the website, implement processes necessary for its proper functionality, confirm the User on the service and ensure the continuity of the User's session on the website, remember the User's location for analyses and research and audience audit, to provide advertising services.

4. The Controller may use external cookies, in particular: in the range of analytical tools, the provision of advertising services, including the purpose of identifying Users who share specific interests, which allows them to present better-selected advertisements to enable the sharing of the content contained on the website on other websites and to let the User go directly to other websites, including social networking sites where the Controller has their profiles.

5. The Controller uses the following external cookies:

2. Using the FB Pixel technology allows you to analyse the User's activities on the website and use the data from these analyses to create groups of advertising recipients and direct advertisements to them tailored to their needs and preferences. 3. To like the Controller's website or go directly to the Controller's profile on social networking sites:

1. You can modify the security settings of your browser, where you can independently allow or block temporary and permanently saved cookies. Detailed information on the possibilities and ways of handling cookies is available in the Help tag in the menu of each browser.

2. By visiting the webpages indicated in Act 5 to opt out of external cookies, including cookies for displaying advertisements based on interests (if the provider or advertising network provides such an option).

7. If cookies are disabled, using the methods set out in this paragraph, there is a risk that some functions on our website will not be available or some websites will not be displayed correctly. We will not associate the data without the User's consent.


§ 6 FINAL PROVISIONS

1. The website may contain links to other websites. The Controller suggests that after being redirected to other websites, you read the privacy policy of those sites there. This Private Policy pertains only to the Controller's website.

2. The Controller uses technical means and organisational solutions to ensure a high level of security of personal data processing appropriate to the threats and categories of protected data and, in particular, their protection against access by unauthorised persons, removal by an unauthorised person, processing in violation of applicable regulations and change, loss, damage or destruction in accordance with applicable law.


This Privacy Policy is also provided to Users free of charge in a PDF version. The User may download it to a private computer without any restrictions.
